The&nbsp;<a href=\"https:\/\/www.gov.uk\/government\/publications\/the-construction-playbook\" target=\"_blank\" rel=\"noreferrer noopener\">Government&#8217;s construction playbook<\/a>&nbsp;also mandates that ground investigation data collected for public works must be deposited with NGDC.&nbsp;<\/p>\n\n\n\n<p>The regulations cover both boreholes drilled for water and those drilled for mineral exploration.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Current legislation for mineral exploration<\/strong><\/h2>\n\n\n\n<p>The Mining Industry Act 1926 s.23 (includes petroleum) requires notification of drilling operations that are 30&nbsp;m or more in depth before drilling commences&nbsp;and deposit of the resulting data on completion of the borehole.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/Geo5\/16-17\/28\/section\/23\" target=\"_blank\" rel=\"noreferrer noopener\">Summary of our role with regards to the Mining Industry Act<\/a><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Current legislation for water boreholes<\/strong><\/h2>\n\n\n\n<p>The Water Resources Act 1991 (England and Wales) requires notification of any drilling operations 15m or more in depth before drilling commences and deposit of the resulting data on completion of the borehole.&nbsp;This includes boreholes drilled for abstraction, trial, monitoring and observation purposes, as well as open-loop ground source heat pump BH\u2019s and deep soakaway boreholes.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1991\/57\/section\/198\" target=\"_blank\" rel=\"noreferrer noopener\">Summary of our role with regards to the Water Resources Act<\/a> <\/li>\n\n\n\n<li>There is separate but similar <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1991\/57\/contents\">legislation for the Water Scotland Act 1980<\/a>&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Who must comply?&nbsp;<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Mineral boreholes<\/strong><\/h3>\n\n\n\n<p>Any person sinking a borehole to a depth of more than 30&nbsp;m for the purpose of searching for or getting minerals must comply with legislation.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Water boreholes<\/strong><\/h3>\n\n\n\n<p>Any person sinking a new well or borehole (or deepening an existing well) to a depth of more than 15&nbsp;m for the purpose of searching for or abstracting water must comply with the legislation.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Ground investigations<\/strong>&nbsp;<\/h3>\n\n\n\n<p>Those conducting ground investigations for public work projects must deposit their data to NGDC using the&nbsp;<a href=\"https:\/\/www.bgs.ac.uk\/ngdc\/ags-data-format\">AGS data format<\/a>.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How do I notify of my intention to drill a well or borehole?&nbsp;&nbsp;<\/h2>\n\n\n\n<p>Companies must notify BGS before a well or borehole is sunk via the\u202f<a href=\"https:\/\/webapps.bgs.ac.uk\/services\/NGDC\/records\/notification\/form.html\" target=\"_blank\" rel=\"noreferrer noopener\">notification form<\/a>. Notification of other borings, sinkings and work not specified in the legislation that may be expected to yield results of interest to NGDC is also welcome.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>When should data be submitted?&nbsp;<\/strong><\/h2>\n\n\n\n<p>Drilling records should be supplied to BGS on completion of the sinking of a well or borehole.&nbsp;Following the notification, BGS may contact you for more information, including specimens of materials extracted as set out in the legislation.&nbsp;<\/p>\n\n\n\n<p>If drilling has already commenced or been completed, please proceed directly with the data deposit.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What should be submitted?&nbsp;<\/strong><\/h2>\n\n\n\n<p>For water wells, a daily record (journal) of the operations should be kept. Such a journal should include, where practicable: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>measurements of water levels during test pumping at recorded time intervals<\/li>\n\n\n\n<li>a drawing or tracing preferably from a six-inch or 1:10&nbsp;000 Ordnance Survey map, showing the precise site of the well<\/li>\n\n\n\n<li>a copy of any analysis of the water<\/li>\n<\/ul>\n\n\n\n<p>The&nbsp;<a href=\"https:\/\/www.bgs.ac.uk\/download\/ngdc-water-borehole-form\/\" target=\"_blank\" rel=\"noreferrer noopener\">NGDC water borehole form<\/a>&nbsp;is a template for capturing all the information required.&nbsp;&nbsp;<\/p>\n\n\n\n<p>A copy of the borehole log should be submitted for mineral boreholes. Deposited data should include, where possible, a geological description, the borehole construction and any groundwater information.&nbsp;<\/p>\n\n\n\n<p>BGS encourages the deposit of machine-readable data for all deposits, so we prefer data in CSV format with a PDF copy of the log.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How is data submitted?&nbsp;<\/strong><\/h2>\n\n\n\n<p>Drilling records must be deposited through the <a href=\"http:\/\/transfer.bgs.ac.uk\/ingestion\">NGDC Digital Data Deposit Application<\/a>.&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Prepare your data according to the\u202fguidance about <a href=\"https:\/\/www.bgs.ac.uk\/ngdc\/deposit-data-with-ngdc\/\">depositing data<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.bgs.ac.uk\/ngdc\/good-data-guidelines\">good data guidelines<\/a>&nbsp;&nbsp;<\/li>\n\n\n\n<li>Access the <a href=\"http:\/\/transfer.bgs.ac.uk\/ingestion\" target=\"_blank\" rel=\"noreferrer noopener\">NGDC Digital Data Deposit Application<\/a>&nbsp;<\/li>\n\n\n\n<li>Complete the submission portal steps to deposit your data, making sure your data is complete and it is the final version<\/li>\n<\/ol>\n\n\n\n<p><strong>Data cannot be edited once it has been deposited<\/strong>.<\/p>\n\n\n\n<p>Whilst not under legislation, we can offer advice on the&nbsp;<a href=\"https:\/\/www.bgs.ac.uk\/ngdc\/borehole-drilling-and-deposit-guidance\">general practice of borehole drilling<\/a> and have specific guidance for those depositing data in the&nbsp;Association of Geotechnical and Geoenvironmental Specialists&#8217; <a href=\"https:\/\/www.bgs.ac.uk\/ngdc\/ags-data-format\">AGS data format<\/a>.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Drilling new boreholes and related notifications&nbsp;&nbsp;<\/h2>\n\n\n<div id=\"borehole-faqs\" class=\"accordions\">\n\t\t\t\t<div class=\"acc-wrap\">\n\t\t\t\t\t<button class=\"acc-top secondary-background icon-arrow button no-btn\"><span class=\"button-content\" tabindex=\"-1\">What is BGS\u2019s remit and what are the driller\u2019s obligations when drilling a water borehole? <\/span><\/button>\n\t\t\t\t\t<div class=\"acc-body sea-background-e\">\n\t\t\t\t\t\t<p><span data-contrast=\"none\">BGS is named in several legal statutes and Acts of Parliament (both in England and Wales, and Scotland). Under the legislation, BGS must be provided with\u202f<\/span><a href=\"https:\/\/webapps.bgs.ac.uk\/services\/NGDC\/records\/notification\/form.html\"><span data-contrast=\"auto\">notification of drilling<\/span><\/a> <span data-contrast=\"none\">before drilling commences for any borehole more than 15\u00a0m deep and the subsequent records of the drilling must be deposited through the\u202f<\/span><a href=\"http:\/\/transfer.bgs.ac.uk\/ingestion\"><span data-contrast=\"auto\">NGDC Digital Data Deposit Application<\/span><\/a><span data-contrast=\"none\">\u202fusing the\u202f<\/span><a href=\"https:\/\/www.bgs.ac.uk\/download\/ngdc-water-borehole-form\/\"><span data-contrast=\"auto\">NGDC water borehole form<\/span><\/a><span data-contrast=\"none\">.<\/span><\/p>\n<p><span data-contrast=\"none\">If you are intending to abstract more than 20\u00a0m<sup>3<\/sup>\/d in England and Wales, you will need to apply for an abstraction licence from the\u202f<\/span><a href=\"https:\/\/www.gov.uk\/government\/publications\/abstracting-water-a-guide-to-getting-your-licence\"><span data-contrast=\"auto\">Environment Agency<\/span><\/a><span data-contrast=\"none\">\u202for\u202f<\/span><a href=\"https:\/\/naturalresources.wales\/permits-and-permissions\/water-abstraction-and-impoundment\/?lang=en\"><span data-contrast=\"auto\">Natural Resources Wales<\/span><\/a><span data-contrast=\"none\">. In Scotland, please consult the\u202f<\/span><a href=\"https:\/\/www.sepa.org.uk\/regulations\/water\/abstractions\/#four\">Scottish Environmental Protection Agency<\/a><span data-contrast=\"auto\"> (SEPA) <\/span><span data-contrast=\"none\">website to make the appropriate application<\/span><span data-contrast=\"none\">.<\/span><\/p>\n<p><span data-contrast=\"none\">Your local council\u2019s environmental health department can advise on appropriate water quality testing. The\u202f<\/span><a href=\"https:\/\/www.dwi.gov.uk\/private-water-supplies\/\"><span data-contrast=\"auto\">Drinking Water Inspectorate<\/span><\/a><span data-contrast=\"none\">\u202fwebsite provides more information on private water supplies in England and Wales. In Scotland, this function is carried out by the <a href=\"https:\/\/dwqr.scot\/private-water-supplies\/owners-and-users-of-private-water-supplies\/\" target=\"_blank\" rel=\"noopener\">Drinking Water Quality Regulator<\/a>.<\/span><\/p>\n<p>Note: BGS is <strong>not<\/strong> the statutory authority with regard to groundwater resources, protection and abstraction in the UK, therefore BGS cannot give permission to drill. Additionally, BGS cannot provide information regarding the necessary planning permission. The best aquifers are generally sandstones, limestones and well-fractured rocks.
