The copyright of BGS maps, publications and other documents:

The copyright of materials derived from the British Geological Survey's work is vested in the Natural Environment Research Council (NERC). No part of this work may be reproduced or transmitted in any form or by any means, or stored in a retrieval system of any nature, without the prior written permission of the copyright holder, which permission the BGS Intellectual Property Rights Manager is empowered to give on behalf of NERC.

The BGS is the successor department to the Institute of Geological Sciences (IGS), for both of whom copyright for maps and other publications is vested in NERC. Copyright of former IGS materials still rests with NERC (BGS), and may not be copied or supplied to third parties without its express consent.

Copyright

  1. Under the provisions of the Copyright, Designs and Patent Act 1988, it is open to NERC (BGS), as the copyright owner, to take measures to prevent infringement and to bring actions against such infringement directly against unlicensed contractors or contractors making use of unauthorised copies.
  2. To ensure that copyright infringements do not arise permission to do any act restricted by copyright in a work must be obtained from the copyright owner. In the case of BGS maps the copyright owner may include both BGS and the Ordnance Survey. Most BGS's geological make use of Ordnance Survey topography, which is Crown Copyright, and BGS acknowledges Crown Copyright (and other copyright proprietors) on its geological maps, and other publications. Reproduction of OS materials may be independently permitted by the licences issued by Ordnance Survey to many users. Users who do not have an Ordnance Survey licence to reproduce the topography must make their own arrangements with the Ordnance Survey, Copyright Branch, Romsey Road, Southampton, SO9 4DH (Tel. 023 8079 2913). An Ordnance Survey licence does not authorise the reproduction of BGS maps; likewise a BGS licence does not authorise the reproduction of Crown Copyright protected materials.
  3. Consent to reproduce BGS materials is normally supplied under a particular copyright licence; and on payment of an appropriate annual fee. An annual licence authorises the licensee to include specific extracts of BGS maps and other documents passed to third parties. A licence does not authorise the licensee to attribute BGS materials as those of the licensee; nor to issue any materials in or on which there is a false attribution.
  4. A licensee is always advised that third parties receiving copies of BGS maps under the licensee's licence, may not recopy the maps in order to pass them on unless prior permission has been obtained from the BGS Intellectual Property Rights Manager.
  5. A BGS copyright licence does not cover any form of digital copying or adaptation, for which specific permission is required. It does not cover any other promotional use of BGS materials; any such use must be agreed separately. The use of BGS photographic materials are subject to a separate permission.

Digital materials

  1. If BGS maps and other graphical materials are to be digitised for a database or GIS, then users should be aware that materials are copyright protected and their transcription (a form of copying) requires permission. Consent is only supplied for materials not currently held in digital form by BGS under a BGS digitising licence. Other digital materials are supplied under a separate BGS Digital Licence. Permission must be obtained from the Ordnance Survey to make and used digital copies of their material.
  2. Where some users have proceeded with their own digitisation of BGS's maps, they may unwittingly or otherwise be in breach of NERC (BGS) copyright. We reserve the right to take appropriate action.
  3. We strongly recommend that potential users refer to BGS for further advice regarding copyright permission for the use and reproduction of BGS digital materials, and /or the digitisation of said materials.
  4. BGS reserves the right to require licensees to provide a copy of the digital data free of charge and to use this material for internal purposes. BGS undertakes not to make commercial use of the material.
  5. BGS is keen to promote business with commercial organisations, institutions, individuals, and educational concerns, which wish to produce and/or publish services and/or products based on BGS materials. In all cases the granting of permission will depend upon the anticipated effect of the proposed usage on the promotion, sales and associated marketing activities involved with BGS's hard copy and digital materials.

Reproduction of BGS Materials for Educational Purposes 2000/2001

1. Introduction

Universities, colleges, schools and educational establishments must obtain prior permission from the BGS before any BGS materials are copied or reproduced for educational use in analogue (paper/hardcopy), electronic/scanned or digital formats. The BGS grants permission for the reproducing its materials either by issuing an EDUCATIONAL COPYRIGHT LICENCE, or giving individual permissions on each occasion that copies are required. Copies may be made for teaching purposes only, either as teaching aids for classes and lecturers, projects or exams set for students.

2. About the copyright of BGS materials
  • The copyright of materials derived from the British Geological Survey's work is vested in the Natural Environment Research Council [NERC]. No part of these materials (geological maps, charts, plans, diagrams, graphs, cross-sections, figures, sketch maps, tables, photographs) may be reproduced or transmitted in any form or by any means, or stored in a retrieval system of any nature, without the written permission of the copyright holder, in advance.

  • The BGS is the successor department to the Institute of Geological Sciences (IGS), for both of whom copyright for maps and other publications is vested in NERC. Some of BGS's and former IGS's materials appear under the aegis of Crown copyright. In most cases this is because the materials are published on behalf of BGS by Crown bodies, like HMSO. In these cases copyright of the original material still rests with NERC (BGS), and can not be copied or supplied to third parties without the copyright owner's express consent.

  • Making copies of part or all of an item, by any means, or in any medium (e.g. photocopying, tracing, drawing, re-drawing, scanning, digitizing, including the manipulation of BGS-based materials in computerized systems), without the owners permission, is an infringement under the Copyright, Designs and Patent Act 1988. The BGS reserves the right to take appropriate action against unlicensed users or users making unauthorized copies.

3. How to obtain permission

To ensure that copyright infringements do not arise permission has to be obtained from the copyright owner. In the case of BGS maps this normally includes both BGS and the Ordnance Survey .

Apply to the BGS Intellectual Property Rights Manager, at the address below, in one of two ways:-
  1. By applying for an educational copyright licence (analogue or digitial);
  2. By individual application for each item (photograph, diagram, map extracts, cross-sections, text, tables) to be reproduced.
Copyright Licences An annual licence is issued each year on payment of a set fee. The licence covers the particular establishment for educational copying only. When a licence is held, there is no need to make an individual application each time BGS materials are reproduced.

Individual applications On each occasion copies are required, a separate application for permission must be made to the BGS Intellectual Property Rights Manager. An assessment is made, and a formal letter of permission issued, with, where appropriate fees are levied, an accompanying invoice. In the course of writing scientific and academic papers, or the reproduction of BGS materials for any commercial undertakings, academic and/or teaching staff wishing to reproduce any BGS materials, will need to seek individual permissions.

Note: Most BGS maps make use of Ordnance Survey topography, reproduction of which may be permitted by the licences issued by Ordnance Survey to many users. Users who do not have an Ordnance Survey licence to reproduce the topography must make their own arrangements with the Ordnance Survey, Copyright Branch, Romsey Road, Southampton, SO9 4DH, United Kingdom, Tel: +44 (0) 238 079 2913.


4. Fees

The annual fees for analogue licences fall into three bands as follows:
  1. Schools for pupils up to 11-16 years old @ £20.
  2. Establishments for students up to 18 years of age @ £50.
  3. Establishments for students over 18 years of age @ £85.
The minimum fee for an individual application is £15.


5. What a BGS Educational Licence permits:-
  1. Copies may be made for teaching purposes only, either as teaching aids for classes and lecturers, projects or exams set for students. The educational establishment must have purchase the original: it may not be borrowed.
  2. Text extracts, in facsimile, scanned, entered by the keyboard or retyped, not exceeding 1000 words may be copied.
  3. Photographs and line drawings may be reproduced. Line diagrams may be reproduced in facsimile, or, provided it is made clear that the original came from BGS, they may be redrawn for teaching purposes.
  4. The size of facsimile copies of maps (completely unamended BGS maps reproduced at or near original scale) is limited to 625 square centimetres (approximately A4 size) at the scale of 1:25, 000 or smaller.
  5. The above size limits do not apply to copies of material which is redrawn, substantially amended or show considerable additions, nor to black and white prints taken from small scale maps.
  6. Each reproduction must cite the BGS publication that it is taken from, and must include the acknowledgement:-

6. What a BGS Educational Licence does not permit:-
  1. Copies made for any purpose other than teaching.
  2. Copies reproduced by outside printers.
  3. Any work intended for sale or distribution to the public or any outside organisation.
  4. The transfer of BGS material onto computer media for any other purposes than those specified in this licence. Permission for such transfer must be sought from BGS.
  5. Digitising and scanning of BGS maps or other illustrative matter or copying of BGS data by outside firms or computer bureaus. Permission for such operations must be sought from BGS, and may be subject to a separate digital licensing agreement (see section 7).
  6. The use of BGS materials on the World Wide Web/Internet sites.

Note:
  • Educational establishments in possession of Copyright Licensing Authority educational use agreements, or other arrangements via the Copyright Licensing Agency (CLA) are not authorized to reproduce BGS maps or map-based products. This authorization is granted only by the BGS via one or more of the appropriate BGS licences and/or permits.
  • An Ordnance Survey licence does not authorise the reproduction of BGS maps, likewise a BGS licence does not authorise the reproduction of Ordnance Survey maps or other materials.

Conditions for Supply of Digital Data 2003/04

1. Copyright

Unless other wise stated, copyright of materials derived from the British Geological Survey's work is vested in the Natural Environment Research Council [NERC]. No part of this work may be reproduced or transmitted in any form or by any means whatsoever, or stored in a retrieval system of any nature, without the prior written permission of the BGS, via the BGS Intellectual Property Rights Manager. The reproduction of BGS materials in analogue or digital formats are authorised via the prior possession of appropriate license(s). Copyright is not transferred to external parties by possession of a BGS license.

2. Definitions

An ‘Affiliate' shall mean any company or organisation (a) in which the licensee at the date of commencement owns directly or indirectly more than 50% of the issued and outstanding voting stock thereof; or (b) which owns directly or indirectly more than 50% of the issued and outstanding voting stock of the licensee or; (c) in which a company described in (b) above, at the date of license commencement owns, directly or indirectly, more than 50% of the issued voting stock. Affiliates shall have the same rights of use of the dataset(s) as has the licensee. The control of, and responsibility for, the use of the dataset(s) shall remain with the licensee.

'Users' those persons employing BGS materials for (a) the production of analogue or electronic/digital publications, services or products based on BGS materials; (b) academic undertakings including educational, teaching/instruction, training, and for research purposes.

‘Licensee'- a holder of a valid BGS Digital Data Set License [and/or other BGS copyright license(s)] appropriate to user requirements.

3. Use of digital data

Permission is granted via a BGS digital data license agreement, which authorises the Licensee to make internal business use of the Data Set(s) exclusively for the benefit of the Licensee; permits the making of back-up copies for security purposes, or to accommodate working procedures. The Licensee is not permitted to use the dataset(s) to provide a bureau service for others or for the benefit of or on behalf of others.

The Data Set(s) may not be assigned, sub-licensed, rented, lent or otherwise transferred. An exception may apply in the case of a licensee's affiliates, contractor or a sub-contractor working on the data in confidence, where for such usage, the affiliates, contractor(s) or sub-contractor(s) will abide by the license terms, and any special conditions contained within an accompanying license schedule. The use of BGS digital data set(s) on the World Wide Web/Internet is prohibited.

4. Hard Copies

No hard copy reports or maps derived from the Data Set(s) may be provided to any person or organisation other than the Licensee, its employees, or its professional advisors, for purposes necessary to the Licensee's internal business. Hard copies may not be incorporated in any publication or on information to be distributed to members of the public or any other party without prior written approval from BGS for which additional copyright fees may be payable.

5. Licensing arrangements

With the exception of confidential holdings, BGS digital data set(s) and other materials are available for use by external parties. These are leased under a non-exclusive license, which is renewable on an annual basis and payment of the appropriate fee. Each license confers permission to use the data set(s) only on the licensee's premises (or on those of the licensee's affiliates, contractors or sub-contractors, subject to provisions of the license). Special arrangements for corporate/multi-site usage are available. No refund of data license fees for portions of digital data set(s) ordered & supplied, but subsequently not used by the licensee, are available.

If the company or organisation holding a BGS License is taken over, or merged with another company, a new license will be required before the resulting company may make use of the data held originally by either company. Based upon the data set(s) requirement and intended usage, a new fee schedule may apply.

6. Academic users

Digital data set(s) are available to individual academic/educational users and/or for educational establishments; solely for teaching/instructional/research purposes. These users are subject to licensing arrangements, and fees will apply. Academic licensees are not permitted to use digital data for commercial undertakings.

It is not intended that any restriction be placed on the publication of scientific papers based on bona-fide academic research using BGS digital data set(s). The express permission of the BGS, through the Intellectual Property Rights Manager, must be sought before such papers are published and the source of the data must be acknowledged.

7. Statutory Bodies & Regulatory users

All external parties employing BGS digital data are to be in possession of an appropriate digital license. This is a mandatory requirement. Digital data set(s) are available solely for the Statutory/ Regulatory Bodies use in the fulfillment of their statutory duties. License fees will apply.

To ensure that all parties are appropriately licensed, third parties working on behalf of Statutory Bodies & Regulatory users will need to be in possession of an appropriate digital license. Such a license will enable third parties use of BGS data, solely for the purposes of fulfilling specific undertakings on behalf of the Statutory Bodies & Regulatory users. In such circumstances, the named third parties would not be charged a license fee.

8. Royalties

Where data are supplied for use in a manipulated or value-added form, to provide a product for consultancy contract or to prepare a tradeable commodity for open sale, (whether offered in analogue or digital form), a royalty is due to BGS. This will be based on the nature of the product/commodity and the number of copies issued. The incorporation of BGS material in a commercial computer-based information system is also subject to royalty payments. The royalty sum and frequency of payment will be subject to agreed terms and conditions of contract. The BGS Intellectual Property Rights Manager must be consulted in advance to ascertain the nature and amount of royalties due and to ensure that any intended product/service does not compromise BGS's own use of the materials. BGS retains the right to acquire without charge, a copy of any value-added product openly marketed and sold, in order to supplement its geological archive.

9. Liability

Use by licensees of digital data set(s) provided by the BGS, is at the licensee's own risk. BGS, nor the Natural Environment Research Council (NERC), gives no warranty as to the quality or accuracy of the information or the medium on which it is provided or its suitability for any use. All implied conditions relating to the quality or suitability of the information and the medium, and all liabilities arising from the supply of the information (including any liability arising in negligence) are excluded to the fullest extent permitted by law.
